ANCOM

ANCOM conducts studies and analyses (including on relevant markets susceptible to ex ante regulation), elaborates guides, methodologies, economic models and principles for the regulation of markets for electronic communications networks and/or services of Romania, thus creating the basis for the specific regulatory decisions.

Also, in order to exercise its legal powers regarding competition monitoring and economic analysis on certain markets in the electronic communications sector, the Authority may commission specialized companies to conduct market studies among end users.

In order to promote competition on the market, ANCOM periodically carries out market analyses on the relevant markets susceptible to ex ante regulation included in the European Commission Recommendation. The Recommendations on relevant markets have been periodically revised by the European Commission (in 2007, 2014, 2020), the relevant markets in force being:

  1. the wholesale market corresponding to local access services at fixed points
  2. the wholesale market corresponding to dedicated capacity services

The Authority may also carry out analyses on markets other than those mentioned above, in accordance with the results of the permanent monitoring of the competitive status of the electronic communications sector in Romania.

The market analyses aim to assess the competitive situation, in terms of the existence or not of providers of electronic communications networks or services with significant market power, and to establish the need to impose ex ante regulatory measures, proportionate to the competition problems identified.

At the same time, ANCOM develops other economic analyses necessary to substantiate regulatory decisions, including regarding the implementation of the national policy in the field of electronic communications.
