On September 26, 2002, the National Regulatory Authority for Communications (ANRC) initiated public consultation on its second normative project, the draft of the "General Authorisation for providing electronic communications services and networks exclusively for private needs".
"The transition to the General Authorisation regime represents an important step towards a free, competitive market. It is an extremely modern mechanism implemented by the West-European states, it is a working method that will break the bureaucratic models and will allow the administration to focus not on issuing documents, but on protecting the consumers’ interests in relation with the networks and services providers", declared ANRC Vicepresident, Alexandrina Hirtan.
The General Authorisation project specifies the conditions to be imposed for installing, operating and controlling the private electronic communications networks that use radio-electric frequencies, as well as for providing services through these networks. The purpose of private electronic communications networks is to facilitate communication among a small number of consumers from within the same company, but only for the private needs of the providers. Any individual who wants to install such an electronic communications network must notify ANRC upon this intention seven days before beginning the activity. According to the new legislation, this notification is the only document needed by providers in order to use the radioelectric frequencies for their own needs. The General Authorisation states the owner`s obligations and rights according to the notification.
After receiving the notifications, ANRC enlists them in order to keep evidence of all the providers. By reducing the amount of documents the providers need to supply for the use of radio-electric frequencies for private needs to only one document, the Authorization will result in simplified procedures contributing to the reduction of bureaucracy and promotion of transparency. At the same time, this general Authorization increases the efficiency of the entire process of obtaining the right to provide radio-electric frequencies for private needs.
The text of the project is available for public consultation on the ANRC web site. All comments will be analysed and used to complete the content of the Authorisation.
