Thursday, February 6, 2003, The National Regulatory Authority for Communications (ANRC) launched for public consultation the following decisions regarding the obligations of mobile telephony operators with respect to the interconnection conditions.
The projects refer to the obligations that ANRC will impose to „Cosmorom” S.A., „Mobifon” S.A., „Orange Romania” S.A. and „Telemobil” S.A.. These are the mobile telephony companies that were designated as operators with significant power on their own mobile telephony network acces market regarding call terminations. The decisions are:
– Decision regarding the interconnection with the public mobile telephony network operated by „Cosmorom” – s.a. as regards call terminations;
– Decision regarding the interconnection with the public mobile telephony network operated by „Mobifon” – s.a. as regards call terminations;
– Decision regarding the interconnection with the public mobile telephony network operated by „Orange Romania” – s.a. as regards call terminations;
– Decision regarding the interconnection with the public mobile telephony network operated by „Telemobil” – s.a. as regards call terminations.
These obligations will be imposed to the above operators according to Government Ordinance no.34/2002 regarding access to public electronic communications networks and the associated infrastructure, as well as their interconnection, approved with amendments and completions by Law no. 527/2002.
The obligations for „Cosmorom” S.A. and „Telemobil” S.A. are: to make public the interconnection tariffs, to provide certain services and access to certain facilities associated to the interconnection of the public mobile telephony network they operate with the networks of other operators, for call terminations.
„Mobifon” S.A. and „Orange Romania” S.A. were imposed further obligations, such as: nondiscrimination, separate accounting, and cost based tariffs. Thus, the two operators must implement, no later than July 1, 2004, a LRIC (Long Run Incremental Cost) cost calculation approved by ANRC. The termination tariffs will be determined based on this method of cost calculating. Until this calculation method is implemented, the interconnection tariffs charged by „Mobifon” S.A. and „Orange Romania” S.A. must observe certain maximum limits, as follows:
– since the date of entry into force of the present decision until December 31, the tariffs shall not exceed 11 USD cents/minute;
– since January 1, 2004 until the date when the interconnection tariffs are calculated based on a LRIC cost calculation approved by ANRC, the tariffs shall not exceed 10 USD cents/minute. The above tariffs correspond to peak hours.
The public consultation for this project ends on February 24, 2003.
