On Tuesday, June 17, 2003, the National Regulatory Authority for Communications (ANRC) launched for public consultation the drafts for the Decision on the designation of “Romtelecom” – S.A. as operator with significant market power on the market of providing leased lines-terminal segments and the Decision on interconnection of leased lines-terminal segments to public fixed telephony network.
By the first draft decision, ANRC designates Romtelecom as having significant market power on the market of providing leased lines-terminal segments, identified by the ANRC Decision no.174/2003 on the completion of the National Regulatory Authority for Communications President’s Decision no.136/2002 on the approval of the Rules on the identification of relevant markets within the electronic communications sector. The leased lines-terminal segments represent the segments of leased end-to-end lines, from the address of the final user to an interconnection point to the transport network of Romtelecom.
The second draft decision sets out the obligations that Romtelecom has, as operator with significant market power on this market, according to the provisions under the legislation on access to, and interconnection of, public electronic communications networks and associated facilities. On grounds of this decision, ANRC imposed to Romtelecom transparency and non-discrimination when concluding the agreements for the interconnection to the networks of other operators, for the provision of leased lines-terminal segments services. Also, Romtelecom has the obligation to provide certain services and to grant access to certain facilities for its partners, as well as to charge cost-oriented the tariffs and to keep separate accounting.
When another company asks Romtelecom for interconnection to leased lines-terminal segments, Romtelecom must offer complete information on its network and negotiate in order to conclude an interconnection agreement. Following the contract conclusion, Romtelecom has the obligation to grant access to all the necessary services so that its partner can provide its own electronic communications services, including access to operational assistance services and to the informational systems or the data bases for processing orders, maintenance and repairing requests.
The draft of the Decision on interconnection for leased lines-terminal segments with the public fixed telephony network also includes the deadlines for the negotiation of the interconnection agreements and the delivery and repairing terms for leased lines, which Romtelecom has to observe when signing the contracts. The deadline for concluding an interconnection framework agreement for leased lines-terminal segments is 2 months from the date when the request is received, and the agreements will be concluded for the period requested by the beneficiaries.
The interconnection services for leased lines-terminal segments made available to the other operators, the conditions under which they are provided and the tariffs charged will make the object of completions to the reference interconnection offer (RIO), published by Romtelecom in February 2003, in accordance with the provisions under ANRC Decision no.147/2002, on the principles and preconditions of the reference offer for the interconnection to public fixed telephony network. On grounds of ANRC decision, Romtelecom must complete the reference interconnection offer until August 1st, 2003.
The public consultation procedure for the draft of the Decision on the designation of “Romtelecom” – S.A. as operator with significant market power on the market of providing leased lines-terminal segments ends on July 7, 2003.
For the draft of the Decision on interconnection of leased lines-terminal segments to public fixed telephony networks, the consultation ends July 16, 2003.
