Today, September 28, 2004, the National Regulatory Authority for Communications launched for public consultation the draft ANRC President’s decisions on the designation of the providers with significant power in the relevant specific retail markets within the electronic communications sector, identified by ANRC President’s Decision no.1124/2004.

According to these draft decisions, S.C. Romtelecom S.A. is designated as a provider with significant power on the following relevant specific retail markets:

1. The market of providing access at a fixed point to a public telephone network for natural persons;

2. The market of providing access at a fixed point to a public telephone network for legal persons;

3. The market of local calls at a fixed location for natural persons;

4. The market of local calls at a fixed location for legal persons;

5. The market of long distance calls at a fixed location for natural persons;

6. The market of long distance calls at a fixed location for legal persons;

7. The market of international calls at a fixed location for natural persons;

8. The market of international calls at a fixed location for legal persons;

9. The market of calls at a fixed location to public mobile telephone networks for natural persons;

10. The market of calls at a fixed location to public mobile telephone networks for legal persons.

Upon the completion of the draft decisions, based on the comments received during the consultation period, ANRC shall impose on S.C. Romtelecom S.A., according to the provisions of Law no.304/2003 on the universal service and the users’ rights regarding the electronic communications networks and services, a set of obligations meant to prevent the abuse of dominant position in the markets where S.C. Romtelecom S.A. was designated as a provider with significant power. Thus, through these measures, ANRC aims to ensure that end users obtain benefits specific to a competition-oriented environment characterised by the diversity of the range of electronic communications and by competitive tariffs.

The new draft decision is available for consultation on the ANRC website. All interested persons are invited to send their comments until October 28, 2004. Comments and recommendations may be sent by mail to the ANRC headquarters at 14 Libertatii Blvd., Bucharest 5, or may be submitted directly to the ANRC registration office or to the territorial office of ANRC.
