On August 14, 2003, the National Regulatory Authority for Communications (ANRC) published on its website “The instructions regarding the control and survey activity of the National Regulatory Authority for Communications within the electronic communications and postal services sector”. The document contains the rules according to which ANRC will develop its activity to control and survey the legal and natural persons acting within the scope of the electronic communications and postal services sector legislation, such as providers or operators.

The control and survey activity consists in obtaining information necessary for the elaboration of reports, studies and analyses, based on which will be determined the opportunities to issue new specific regulations, will be evaluated and controlled the policies and regulations implementation, will be verified the observance of the obligations imposed to the providers of electronic communications services and networks and postal services. The survey operations are developed through the authority’s central and territorial divisions, ex officio or at the intimation of other persons.

The control activity includes verifying the legal or natural persons who develop activities within the electronic communications and postal services sector in order to determine if they observe the specific legal provisions. The control activities are initiated by the President of ANRC, at the ANRC divisions or other person’s intimations. During the control procedure, the authorized personnel of ANRC will use the standard forms for control notice, statement of facts and notification on the intention to sanction. These forms, as well the badge model, are attached to the document.
