In order to conclude an agreement for the unbundled access to the local loop, the interested operator must submit a written request, personally or by fax, to the number specified in the Frame Agreement for the Unbundled Access to the Local Loop (Appendix 1, pg. 102), to the CARRIER SERVICES DEPARTMENT, 35 Calea Victoriei, Bucharest, Sector 1, telephone: (021) 400 5001, fax: (021) 400 5009, whereby the respective operator states its intention to negotiate and conclude an agreement for the unbundled access to the local loop (purchase at the wholesale level the access services provided in the Reference Unbundling Offer). The 45- working day term provided under Art.35 of the ANCOM President’s Decision no.653/2010 will be counted from this moment on.
If, in the above-mentioned request, the interested operator agrees on the standard conditions for the unbundled access to the local loop and indicates the access points, the access and the co-location options, as well as the other services to be purchased, the negotiation term will not exceed 25 working days from the date of receiving the request.
What is subject to negotiation? The parties negotiate the provisions (terms and conditions) of the respective frame-agreement. There is a frame access agreement provided by Romtelecom S.A. to any interested operator. In order to speed up the conclusion of the access agreements, in accordance with all the legal provisions, any of the parties may require ANCOM, on an informal basis, further explanations on the agreement provisions under negotiation.
A key-issue for the negotiation process is the provision by Romtelecom S.A. of complete information an operator may need in order to efficiently choose the access points for the unbundled access to the local loop. Therefore, a confidentiality agreement will be signed, upon which Romtelecom S.A. allots the operator a password allowing the respective operator to visit the restricted area of the Romtelecom S.A. website, where relevant information on the Romtelecom access network is available, in order to ensure the unbundled access to the local loop under efficiency conditions.
After having consulted the information in the RUO, as well as the data available in the restricted area of the S.C. Romtelecom S.A. website, an operator may submit a request for the unbundled access to the local loop.
