On Wednesday, August 8, 2007, ANRCTI communicated the decision on the interconnection with the public telephony network operated by S.C. „RCS & RDS” – S.A. for the purpose of call termination at fixed locations.
According to the ANRCTI President’s Decision no.2849/2007, RCS & RDS is obliged to publish on its website – within 3 days – certain information related to its access points as well as to the tariffs charged for all services and facilities associated to interconnection. The maximum term provided for the conclusion of an interconnection agreement will be 2 months from the date RCS & RDS receives a request in this regard, whereas the maximum term for the implementation of the interconnection agreements will be 3 months from their conclusion. As regards the interconnection requests transmitted to RCS & RDS by June 20, 2007, this date included, the maximum negotiation term shall be 15 days from the decision communication date.
Furthermore, RCS & RDS will have the obligation to submit to ANRCTI a copy of each of the interconnection requests and, respectively, of each of the requests for the amendment, completion or withdrawal of the initial request, within 2 days after receiving them.
The tariff charged by RCS & RDS for the provision of the interconnection service for the purpose of call termination at fixed locations may not exceed the value of 1.15 eurocents/minute, excluding VAT.
The provisions of this decision aim at ensuring a transparent legal framework regarding the interconnection with the public fixed telephony network operated by RCS & RDS. In its activity, ANRCTI pursuits to ensure the effective competition on the electronic communications market, by taking all the necessary measures in order to prevent the abusive behaviour of the operators controlling the access to end-users, with a view to ensure the end-to-end connectivity.
In accordance with the provisions under art.5 of Government Ordinance no.34/2002, in view of ensuring end-to-end connectivity, ANRCTI is legally entrusted to impose on RCS & RDS – in its capacity as operator that controls the access to end-users – the obligation of realizing the interconnection of its own network, as well as of establishing the conditions under which it will ensure the interconnection. Decision no.2849/2007 was adopted following the procedures of national public consultation and after the European Commission and the regulatory authorities of the other Member States have been notified in accordance with arts. 341 and 50 of Government Emergency Ordinance no.79/2002.
