Today, September 7, 2007, comes into force the ANRCTI President’s Decision no.2858/2007 on the general authorisation regime for the provision of postal services, published in the Romanian Official Journal, Part I, no.608 of September 4, 2007.

According to the provisions of the decision, the barriers to entry on the market of postal services encountered by the natural persons were eliminated, whereas the procedure of authorising the persons who request to be granted the right to provide postal services was simplified. As well, the standard certificate provides the exact date when a provider that submitted a notification gains the right to provide postal services.

With the entry in force of this Decision, the classification of postal services has been reviewed; in this regard, the scope of universal service is strictly determined by the establishment and definition of the services which are not included in it (for instance, the Cash-on-delivery, Change of destination, Special delivery, Postal proof of delivery and Express services). On the other hand, the direct mail services are included in the scope of universal service.

Another objective of the Decision no.2858/2007 refers to explicitly setting out certain rules applicable to postal services, as well as to the minimum general conditions regarding their provision, especially by thoroughly regulating the contract of postal services provision.

An important consequence provided by the adoption of this Decision is the obligation of all current providers to submit a new notification, by December 31, 2007, in order for their services to be included in the new classification. ANRCTI shall start as soon as possible an information campaign in order to make the providers aware of these aspects.

During 2006, came into force the Government Emergency Ordinance no.70/2006 on the amendment and completion of certain normative acts in the field of electronic communications and of postal services, which lead to the repeal of the ANRC President’s Decision no.118/2003 on the authorisation of postal services providers, as well as to the issuance of a new decision, in accordance with the new legislative provisions.
