According to the draft decisions launched for public consultation today, October 9, 2008, the National Authority for Communications (ANC) proposes that National Radiocommunications Company – S.A. (SNR) be designated operator with significant power on the relevant markets for the services of analogue broadcasting public audio and video programme services by means of terrestrial radioelectric systems, as well as the imposition of obligations regarding the control of the tariffs charged by SNR.

Having conducted market analyses, ANC found evidence on the existence of potential competition deficiencies in this sector. These deficiencies are mainly due to the position of SNR in the market for the transmission services ensuring the public reception of audio and video programmes of the National TV and Radio Broadcasting Companies. ANC proposes the imposition, on SNR, of the obligations of tariff control and cost-orientation. Therefore, ANC will submit to public consultation and adopt a set of regulations regarding the elaboration of the cost calculation model and – within one year from the adoption date – SNR should elaborate and implement this model.

The draft decision on the identification of the relevant markets for the services of analogue broadcasting public audio and video programme services by means of terrestrial radioelectric systems is available for consultation on the ANC website. All interested persons are invited to submit their comments and suggestions by November 10, 2008, to the ANC headquarters in 2 Delea Noua Street, sector 3, Bucharest or directly to the ANC registration office, as well as to its territorial offices in the closest county capital city.
