The National Authority for Communications of Romania has been reorganised into the National Authority for Management and Regulation in Communications (ANCOM), an autonomous public authority with legal personality, under parliamentary control.
ANCOM has the role of enforcing the national policy in the fields of electronic communications, audio-visual communications and postal services, including by market regulation and by technical regulation in these fields.
ANCOM administrates and manages the scarce resources in the field of electronic communications, such as the radio frequency spectrum, the numbering resources and other associated technical resources and monitors the radio frequency bands for non-governmental use. Furthermore, ANCOM controls compliance with the requirements regarding electromagnetic compatibility, the efficient use of the radio spectrum, observance of the obligations on the use of the numbering resources and of the associated technical resources and ensures the control of the market of radio equipment and of terminal telecommunications equipment.
The new authority created by the Government Emergency Ordinance no.22 of 11 March 2009, published in the Official Journal no.174 of 19 March 2009, does no longer have attributions in the regulation and surveillance of the IT field, including in sanctioning the transmission of unsolicited commercial messages. These attributions have been taken over by the Ministry of Communications and Information Society.
Within 60 days from the date of entry into force of this ordinance, the institution’s Rules for the Organisation and Functioning and organisational structure will be approved by ANCOM’s President Decision.
The ANCOM management is ensured by a President and 2 Vice-presidents, appointed by the President of Romania, upon the Government’s proposal, for a 6-year mandate, with the possibility of extending this mandate once, for a similar period.
