The representatives of the Romanian National Authority for Management and Regulation in Communications (ANCOM) have had a series of meetings this month with the local public authorities across the country in order to present them in detail the duties incumbent on them upon the adoption of Law no. 154/2012 regarding the regime of the electronic communications networks infrastructure. These meetings are part of an information campaign which ANCOM began early this year to facilitate the implementation of the Infrastructure Law.
Aiming at facilitating the implementation of the provisions of the Infrastructure Law, a normative act which affects the activities of the providers of electronic communications networks, as well as the local public authorities, building owners and other infrastructure holders, ANCOM is conducting an information campaign this year which entails meetings with the local authorities across the country in order to help them clarify some concrete aspects concerning the implementation of this normative act and to gather insights on the specificities of the enforcement of this law at the local level.
One of the objectives pursued by these series of meetings is to have the conditions of access on the public properties held by at least 80% of the country’s administrative-territorial units drafted and sent to ANCOM by the end of October in order to be inserted in the database the Authority is managing.
Until now, the ANCOM representatives have had individual meetings with the representatives of about a quarter of the city halls. In some counties, they also attended the plenary meetings held by the representatives of the county authorities, prefectures or county councils. Such plenary meetings, attended by more than 350 representatives of the local public authorities, took place in the counties of Arad, Botosani, Constanta, Dambovita, Giurgiu, Iasi, Olt, Prahova and Teleorman. Similar meetings are to take place by the end of this month in the counties of Arges, Braila, Brasov and Calaraşi.
Furthermore, in order to support all interested parties, the Authority created a dedicated section on its website, called Infrastructure Law, which itemizes the provisions of the Law by the targeted category of public – providers of electronic communications networks, public authorities, owners/owners’ associations and infrastructure holders. This section will also host the database with the conditions of access on the public properties.

Law no. 154/2012 regarding the regime of the electronic communications networks infrastructure is intended for supporting the development of the electronic communications networks at the national level and incentivizing investments in communications networks and infrastructures, as well as for encouraging competition among the providers of public electronic communications networks. The Law lays down the conditions for access on the public or private property in view of installing, maintaining, replacing or relocating electronic communications networks or associated infrastructure elements, the conditions on the share used of the infrastructure elements, as well as certain measures on the building of electronic communications networks.
Under this Law, the public authorities have the obligation to publish, within 30 days from receiving the first access request, the conditions for the access on the public property, as well as the list of the documents necessary for granting such access. Furthermore, the public authorities have the obligation to submit to ANCOM the copies of the conditions for the access on the public property of the state or of the administrative-territorial units.
As well, in the case of the infrastructure projects which were performed or are being performed with the participation of the central or local public authorities or which are fully or partly financed from public funds, the public authorities must submit to ANCOM the technical and economic conditions for the providers’ access to the infrastructure, in view of obtaining the notice of approval.
