ANRC has calculated the estimated monitoring tariff for 2006 as a percentage of 0.13 of the turnover, based on the financial statements transmitted to the Authority, as of June 30, by 2021 providers of electronic communications and 171 providers of postal services (out of the total number of 2390 providers authorised by ANRC, by the end of 2005). As compared to last year’s tariff, which was calculated as 0.30% of the companies’ turnover, the percentage established for 2006 is 2.3 times lower. This economy is due to ANRC’s more efficient operation.
The percentage taken into account for establishing the monitoring tariff is calculated as a ratio between the ANRC expenditure, as provided in the authority’s budget for the current year, and the turnover declared by the providers of electronic communications and of postal services for the year 2005 (the operators who chose to pay the monitoring tariff based only on the revenue from the provision of electronic communications or postal services are to be applied a calculation formula that considers the respective amount exclusively). The estimated monitoring tariff for 2006 was calculated based on an amount of approximately 12.11 billion RON – respectively more than 3.34 billion Euro (as denominated by the NBR average exchange rate for Euro in 2005 – 3.6234 RON/Euro).
The resulting monitoring tariff will be communicated to each of the providers, who are to pay it in two equal instalments: the first – within 30 days from the communication of the respective decision and the second – no later than December 31, 2006.
The percentage used in the calculation of the monitoring tariff will be reconsidered in the process of determining the final monitoring tariff, as soon as ANRC receives the financial statements of the 198 providers who have not yet complied with their obligation to submit their financial statements.
The 179 providers of electronic communications and the 19 providers of postal services who have not yet submitted their financial statements to ANRC will receive contravention fines. Furthermore, these operators’ right to provide electronic communications or postal services could be suspended.
Due to ANRC’s involvement, in 2005, the legislative framework has been modified. Therefore, from 2006, the operators may choose that their monitoring tariff be calculated based either on the entire turnover, or on the revenue resulted exclusively from the provision of electronic communications or postal services. Moreover, starting from 2006, a single tariff, calculated by means of the above mentioned formula, will be charged both for electronic communications and for postal services.
