ANRCTI submits to public consultation the new Regulation on its organisation and operation, after the settlement in December, 2006, – on grounds of art.1 paragraph (1) of the Government Emergency Ordinance no.134/2006 – of the National Regulatory Authority for Communications and Information Technology (ANRCTI), a public institution with legal personality subordinated to the Government, fully financed from extra-budgetary revenues, by means of re-organising the National Regulatory Authority for Communications, which was dissolved.
In this context, it is necessary to adopt a new Regulation on the organisation and operation of ANRCTI, mainly taking into account that ANRCTI overtook the regulatory attributions in the field of electronic communications and postal services – which were totally transmitted to the new authority – and certain attributions in the sector of information technology. As well, the authority’s leadership structure was modified. Thus, the leadership of ANRCTI is assured by a president and two vicepresidents (ANRC had only one vicepresident).
The draft proposes to regulate the main aspects related to the organisation and operation of ANRCTI, as well as clarify its attributions. Therefore, the provisions therein refer to: the authority’s status, role and attributions, ANRCTI financing, authority’s leadership and leaders’ attributions, organisation and personnel structure, as well as certain aspects regarding the operation of ANRCTI.
“Taking into account that the Government Emergency Ordinance no.134/2006 established ANRCTI as a regulatory authority in the field of information technology, it is necessary to identify its concrete attributions in this field. According to the draft Regulation on its organisation and operation, ANRCTI shall overtake the regulatory attributions as regards the electronic signature, electronic commerce, temporal marking services and electronic notarial activities”, Dan Georgescu, the president of ANRCTI, declared.
As well, in order to ensure the unitary regulation of the Internet access services, ANRCTI shall establish the procedure for the administration of TLD (top level domain) “.ro” and of IP addresses. Their effective administration shall be subsequently fulfilled by the National Institute for Informatics Research and Development, institution which disposes of the necessary equipments and databases.
The draft Regulation on the organisation and operation of ANRCTI is available for consultation on the website of ANRCTI. All interested persons are invited to send their comments and suggestions by March 23, 2007, by mail, to the ANRCTI headquarters (14 Libertatii Blvd., sector 5, Bucharest) or directly to the ANRCTI registration office or to the closest territorial office of ANRCTI.
