ANRCTI launches for public consultation a draft decision on the procedure for determining the monitoring tariff, as well as on the exertion of the right to choose as regards the financial obligations of the companies in the fields of electronic communications and postal services.

According to the draft decision, the providers of public electronic communications networks, of publicly available electronic communications services or of postal services which register a turnover that does not exceed the equivalent in lei of 100,000 euros – at the average exchange rate on the date when the turnover was achieved -, computed based on the monthly average exchange rate provided by the Romanian National Bank, are no more obliged to pay the monitoring tariff owed to ANRCTI, according to the provisions of Law no.133/2007 for the approval of the Government Emergency Ordinance no.70/2006 on the amendment and completion of certain normative acts in the fields of electronic communications and postal services.

Moreover, this exempt is applicable for the persons whose capacity as providers of public electronic communications networks, publicly available electronic communications services or postal services ends. Therefore, for the respective persons, the amount of 100,000 euros will be reported to the turnover realized during the previous year or during the months of the year prior to the moment when their capacity as providers ended, cumulated with the turnover realized during the months when they had this capacity, in the year during which it ends, if the capacity as a provider ended before the establishment of the annual monitoring tariff and, respectively, to the turnover realized during the months when they had this capacity, in the year during which the capacity ended, if the capacity as a provider ended after the establishment of the annual monitoring traffic.

The provisions of this draft decision enable ANRCTI to verify the correctness of the statements – submitted by the providers in order to determine the monitoring tariff related to the turnovers realized during the months of the previous year, as well as during the months of the year when the capacity as a provider ended – along with the synthetic trial balances prepared in the respective months.

Furthermore, certain amendments were introduced with a view to ensure a greater flexibility regarding the possibility of the providers of public electronic communications networks, publicly available electronic communications services or postal services to change their decision as regards the calculation of the monitoring tariff depending on the turnover or on the revenues achieved from the provision of electronic communications networks or services or from the provision of postal services.

The draft decision on the procedure for determining the monitoring tariff, as well as on the exertion of the right to choose as regards the financial obligations owed to the National Regulatory Authority for Communications and Information Technology, consisting of a monitoring tariff and a contribution for the compensation of the net cost for the provision of services within the scope of Universal Service is available for consultation on the ANRCTI website. All the interested persons are invited to submit their comments and suggestions by August 1, 2007, to ANRCTI headquarters in 14 Libertatii Blvd, Bucharest 5 or directly to the ANRCTI registration office, as well as to the closest territorial office in the municipality residence.
