ANRCTI launches for public consultation the draft decision on the procedure for granting a licence for the use of radio frequencies on view of providing mobile electronic communications networks and services within the frequency bands 410-415/420-425 MHz.

According to the provisions of Government Decision no. 61/2008 on the selection procedure for granting a national licence for the use of radio frequencies in view of providing mobile electronic communications networks and services within the frequency bands 410-415/420-425 MHz, ANRCTI will organise a tender for awarding this licence.

In conformity with the provisions of the draft decision proposed by ANRCTI, the preliminary steps for the tender are elaborating the draft terms of reference, publishing the draft terms of reference in view of the public consultation, sending comments on the content of the terms of reference, elaborate the final version of the terms of reference and publishing the tender announcement. A detailed schedule of the tender stages will be established by the terms of reference and ANRCTI estimates that the procedure should be completed and the winner designated by July 31, 2008.

The draft decision, pursuant to Article 3 of the Government Decision no. 61/2008, provides that the tenderers cannot include operators that hold at least one national licence for the use of radio frequencies in view of providing mobile electronic communications networks and services within the frequency bands 880 – 915 MHz / 925 – 960 MHz (GSM 900), 1710 – 1785 MHz / 1805 – 1880 MHz (GSM 1800), 453 – 457,5 / 463 – 467,5 MHz (CDMA 450) or 1920 – 1980 / 2110 – 2170 MHz (IMT 2000/UMTS – FDD) and, respectively, 1900 – 1920 MHz (IMT 2000/UMTS – TDD).

In view of organising and conducting the tender procedure, ANRCTI will designate a commission consisting of 7 members that cannot be shareholders, managers, auditors or employees – based on a labour book or on any other means – of any of the legal entities who take part in the tender or who control a tenderer. The tender commission will elaborate the terms of reference and, subsequently, the final version of the terms of reference, will elaborate the answers to requests for clarifications, will assess the offers and present the conclusions to the ANRCTI President, for approval.

ANRCTI will publish on its website – www.anrcti.ro, in view of the public consultation, the draft terms of reference and the deadline for sending comments and suggestions on it. The final version of the terms of reference will be elaborated upon consolidating and analysing the comments and suggestions.

ANRCTI will publish, at least in one newspaper distributed countrywide, as well as on its website, a tender announcement, inviting the interested persons to apply for the terms of reference.

The tenderers will have to set up a guarantee for an amount of EUR50,000, under the form of a letter of bank guarantee issued by a Romanian bank or by a foreign bank with a Romanian correspondent bank.

The results of the tender assessment will be posted on the Authority’s website.

The draft decision on the procedure for granting a licence for the use of radio frequencies on view of providing mobile electronic communications networks and services within the frequency bands 410-415/420-425 MHz is available on the ANRCTI website. The interested persons are invited to send their comments and suggestions by 10.03.2008, to the ANRCTI headquarters (14 Libertatii Blvd., sector 5, Bucharest) or directly to the ANRCTI registration office, as well as to its territorial offices in the closest county capital city.
