ANRCTI launches for public consultation the Decision of the President of the National Regulatory Authority for Communications and Information Technology on the conditions and procedure for the designation of the Universal Service providers in the field of postal services.

The draft decision submitted to public consultation today aims at adapting the Regulatory framework to the amendments brought to the Government Ordinance no.31/2002 on postal services by the Government Emergency Ordinance no.70/2006 on the amendment and completion of several normative acts in the field of electronic communications and postal services, approved with amendments and completions by Law no.133/2007, and will replace the ANRC President’s Decision no.1.351/2003 on the conditions and procedure for the designation of the universal service providers in the field of postal services.

The amendment of the legislation, necessary for the full alignment to the European norms, imposed the reanalysis of the procedure for the designation of the Universal Service providers following the simplification of the procedure of authorising the postal services providers by eliminating the individual licence for the provision of postal services included in the scope of universal service. The draft decision assimilates this amendment, so that the eligibility of the postal services providers to be designated as Universal Service providers is not conditioned anymore by their capacity as holders of the individual licence.

Therefore, the draft decision provides that a Universal Service provider may be the postal service provider authorised to provide the services within the scope of universal service for which he is to be designated, under the general authorisation regime.

As regards the effective procedure for the designation of the Universal service providers in the field of postal services, the draft provides two methods: upon the request of the providers of postal services included in the scope of universal service interested in becoming Universal Service providers (after ANRCTI publishes an announcement, on its website and in a significant daily paper, regarding the intention to designate one or several Universal Service providers) or ex officio (if no provider requires to be designated).

Furthermore, the draft has established certain elements to be included in the decision for the designation of the Universal Service providers: the services for which they were designated as Universal Service providers, the designation period, as well as their specific rights and obligations in their capacity as Universal Service providers, supplementary to those provided under the general authorisation.

The draft decision on the conditions and procedure for the designation of the Universal service providers in the field of postal services is available for consultation on ANRCTI website. The interested persons are invited to send their comments and suggestions by November 22, 2007 to the ANRCTI headquarters (14 Libertatii Blvd., sector 5, Bucharest) or directly to the ANRCTI registration office, as well as to its territorial offices from the closest county capital city.
