Today, March 28, 2008, the Decision of the President of the National Regulatory Authority for Communications and Information Technology no.241/2008 on the procedure of granting a new licence for the use of radio frequencies with a view to provide mobile electronic communications networks and services within the 410-415/420-425 MHz frequency bands was published in the Romanian Official Journal no 242, Part I.

The licence for the use of radio frequencies in view of providing mobile electronic communications networks and services within the 410-415/420-425 MHz frequency bands shall be granted by ANRCTI through public tender. According to the Government Decision no. 61/2008, the holders of at least one national licence for the use of radio frequencies in view of providing mobile electronic communications networks and services, including broadband, that could or are providing mobile electronic communications networks and services that may be substituted by those provided by using the 410-415/420-425 MHz frequency bands may not participate in the tender.

ANRCTI shall continue the stages to be underwent prior to the tender, respectively elaboration of the Draft Terms of Reference, publication of the Terms of Reference in order to launch it for public consultation, submission of comments on the content of the Terms of Reference, the elaboration of the final form of the Terms of Reference and the publication of the tender notice. The detailed calendar of the tender stages shall be established through the Terms of Reference, and ANRCTI estimates that the procedure shall be completed and the winner shall be announced this summer.

The Terms of Reference shall be prepared by a commission – consisting of 7 members. The document shall necessarily include the technical conditions for the use of the tendered frequency bands, the minimal requirements the tenderer will have to observe if it wins the tender, the scoring grid, as well as any other aspects the tender commission considers relevant.

As well, the commission shall organise and manage the tender procedure, shall elaborate the answers to the requests of explanations, shall assess the offers and shall submit its results to the President of ANRCTI for approval.

Following the public consultation and analysis of the comments on the Terms of Reference, ANRCTI shall publish a tender notice in at least one national journal, as well as on its website. The results of the offer assessment shall be made public on the Authority’s website –www.anrcti.ro.
