ANCOM submits to public consultation the draft decision regarding the conditions for establishing the licence fee that will be paid by the winners of the selection procedures for granting the licences for the use of the radio spectrum in the Digital Video Broadcasting – Terrestrial (DVBT) system.

According to the Government Decision no.464/2010 on granting the licences for the use of the radio spectrum in the Digital Video Broadcasting – Terrestrial (DVBT) system and on amending the Government Decision no.1213/2009 approving the Strategy regarding the transition from analogue television to digital televisions and the implementation of digital multimedia services at a national level, approved by the Government Decision no.1213/2009, the licence fee may range between EUR 2,500,000 and EUR 1,000,000. The exact value of this licence is to be established by a decision of ANCOM, taking into account the number of set-top boxes to be subsidized.

Based on the number of set-top boxes the operators undertake to subsidize, seven instances that will determine de value of the licence fee have been identified:

EUR 2,500,000, in case of subsidizing no more than 10,000 set-top boxes;

EUR 2,250,000, in case of subsidizing 10,001 – 20,000 set-top boxes;

EUR 2,000,000, in case of subsidizing 20,001-30,000 set-top boxes;

EUR 1,750,000, in case of subsidizing 30,001-40,000 set-top boxes;

EUR 1,500,000, in case of subsidizing 40,001-50,000 set-top boxes;

EUR 1,250,000, in case of subsidizing 50,001-60,000 set-top boxes;

EUR 1,000,000, in case of subsidizing more than 60,000 set-top boxes.

ANCOM will verify the compliance with the obligation to subsidize set-top boxes at the level undertaken as of 1 January 2012 and, should breaches be assessed, the amount of the licence fee will be recalculated, the respective licence holder having the obligation to pay the difference within 30 days from the date of receiving the ANCOM President’s decision.

The subsidizing manner and the procedure on the distribution of the set-top boxes, as well as the categories of users who can benefit from subsidized equipment, will be established by a subsequent ANCOM decision.
