The National Authority for Management and Regulation in Communications of Romania has published for consultation the draft decision on the security of public electronic communications networks and publicly available electronic communications services. The draft decision aims to harmonize the secondary legislation with the provisions of the primary legal framework in the field.
Main amendment proposals
The main changes that the draft decision proposes concern technical and organisational measures to be taken by providers of public electronic communications networks or publicly available electronic communications services, in order to adequately manage risks to the security of electronic communications networks and services.
Regarding the reporting of security incidents, the amendments include defining significant impact according to more criteria than quantitative thresholds (number of affected users and duration of the incident). The additional criteria provide a set of qualitative thresholds, such as incidents that affect the routing of emergency communications to the 112 emergency service or the ensuring of critical communications services.
The draft decision also introduces new elements, such as the establishment of an Electronic Communications Security Advisory Group. It would be composed of ANCOM representatives and providers of public electronic communications networks or publicly available electronic communications services with at least 100,000 connections. This group will aim to promote harmonization of security measures, foster cooperation, assess emerging risks, facilitate the exchange of information and best practices, analyse challenges to the security of networks and services.

Interested persons are invited to submit their comments and suggestions, no later than 01 September 2023, at ANCOM’s headquarters (2 Delea Noua Street, sector 3, Bucharest), using the online Registry or through the Authority’s Regional Divisions.
