The Romanian Authority for Management and Regulation in Communications (ANCOM) discussed with the industry, yesterday, during a Consultative Council meeting, a decision that brings amendments and completions to the general authorisation regime applicable to the providers of postal services, in view of the entry into force of the new legal framework in the postal services field.
This decision was adopted following the necessity of transposing the new provisions into the secondary legislation, thus, it brings amendments to some of the conditions under which the providers of postal services benefit from the general authorisation regime, as well as to the rights, respectively to the obligations they have as authorised providers.
Thus, the procedure for obtaining the right to provide postal services was simplified, a requester having the possibility to send any document that may certify the quality and rights conferred on the person designated by the provider to represent it in relationship with third parties or with ANCOM.
The procedure of suspending the right to provide postal services in case of temporary inactivity was reviewed, as well. Thereby, suspending may be effected both upon a provider’s request and ex officio, following ANCOM’s assessment of the provider’s inactivity.
As regards the sanction of suspending the right to provide postal services, throughout this period, the providers will preserve their obligation to provide postal services exclusively in relationship with ANCOM, losing this right in relationship with other natural or legal persons – given the sanctioned person’s impossibility to provide the services for which the sanction was imposed and, implicitly, to exercise its obligations to other natural or legal persons, as a provider of postal services.
Moreover, in accordance with the new provisions, the categorisation of postal service types was updated. Thus, the document adopted today regulates the money order on paper support as a postal service, also establishing the conditions applicable to the provision of this service. Furthermore, the direct mail service dealing with items up to 2 kg is regulated as a service outside the scope of universal service, cecogrammes are provided as a distinct postal service, included in the scope of universal service, while the document exchange service is not considered a postal service anymore.
According to the provisions of the new legal framework, the providers of cecogrammes and money order on paper support have the obligation to notify these services within 15 days from the entry into force of the decision. On the other hand, within 6 months from the entry into force of this decision, the Authority will issue, ex officio, an updated standard certificate to all the providers who have the right to provide the direct mail service.
