ANCOM communicated to Infoclick and Newsphone Hellas, represented in Romania by Newsphone Hellas S.A. Athens Greece Bucharest Branch, the decision on the withdrawal of the capacity as universal service providers designated for making available a directory enquiry service and, respectively, an electronic subscriber directory. The withdrawal of the capacity as a universal service provider is the result of their non-compliance with the obligations deriving from this capacity. The deviations were assessed by ANCOM during the controls conducted from the moment of designation until now.
Hence, a control conducted in June 2010 revealed that the providers failed to observe their obligation to publish 6,000,000 copies of a printed subscriber directory, pursuant to their commitment expressed in their submitted offers, and therefore ANCOM transmitted the concerned providers a notification on the sanction enforcement, granting them an additional period of time to remedy or justify accordingly the breach of the obligation.
Considering that the justification the providers transmitted to ANCOM was not grounded, upon the expiry of the term granted, the Authority’s entitled personnel conducted a new control action meant to verify whether the providers recovered their lawful status. Having found that the concerned universal service providers were still breaching the assumed obligations, ANCOM sanctioned them with a contravention fine amounting to RON 15,000, and also decided to obligate them to publish the 6,000,000 copies of the printed subscriber directory within 30 days from the communication date of the sanctioning decision.
Considering that, at the time of the last control conducted on 15 March 2011, the two providers were not able to prove that they had published the 6,000,000 copies of the printed subscriber directory, ANCOM decided to sanction the two undertakings by withdrawing them the capacity as universal service providers.
Therefore, starting 31 March 2011, the communication date of the decision, ANCOM withdraws the capacity as universal service providers from Infoclick and Newsphone Hellas,represented in Romania by Newsphone Hellas S.A. Athens Greece Bucharest Branch, whereas all the rights and obligations under the decisions on their designation as universal service providers cease.
