In December 2003, ANRC submitted for public consultation the draft decisions on the amendment of the ANRC President’s Decision no.123/2003 and no.124/2003 on the interconnection with the public mobile telephony network operated by S.C. “Mobifon” – S.A. and S.C. „Orange România” – S.A. for the purpose of call termination.

Through decisions no.123/2003 and no.124/2003, ANRC imposed the reduction of the maximal tariff charged for call termination in the mobile networks of the operators to USD 10 cents/minute starting January 1, 2004. This was considered an appropriate measure as there was proof that these operators could recover the costs for the provision of the service. Taking into account that in 2003 there were major fluctuations on the stock exchange market, a strong devaluation of the USD compared to the Euro and the ROL, ANRC analyzed whether the above mentioned cost recovering could still be ensured, and initiated, through the public consultation process, discussions on the necessity of changing the ANRC President Decisions no.123/2003 and no.124/2003.

The projects for amending the above mentioned decisions were initiated as a result of the requests forwarded by S.C. „Mobifon” – S.A. and S.C. „Orange România” – S.A.. Thus, ANRC pursued its objective of taking under advisement the requests of the marketplayers and launched a consultation process to gather feedback on the impact of this measure from all the electronic communications providers active on the market.

Following this analysis and taking into consideration the feedback received, ANRC considers that it is not necessary to renounce the decrease of the maximal call termination tariff from USD11 cents/minute to USD 10 cents/minute and to maintain its level at USD 11 cents/minute until the finalizing of the „bottom-up” long run incremental costs calculation model. This measure was no longer required, as there was sufficient proof that a tariff of USD 10 cents/minute ensures the recovery of the costs with the provision of the above mentioned interconnection service.

Considering that any unjustified postponing of the constraint regarding the cost orientation of the tariffs will affect both the other providers and the functioning of market as a whole, ANRC decides to withdraw the draft Decisions on the amendment of the ANRC President’s Decision no.123/2003 and no.124/2003 on the interconnection with the public mobile telephony network operated by S.C. “Mobifon” – S.A. and S.C. „Orange România” – S.A. for the purpose of call termination, and, thus, to maintain the obligation of these two companies to reduce the maximal call termination tariff to USD 10 cents/minute, starting January 1, 2004. This tariff will be charged until the interconnection tariffs are determined by a long run incremental cost calculation model approved by ANRC.
