On Monday, May 19, 2003, the ANRC’s President Decision no.174/EN for the completion of the National Regulatory Authority for Communications President’s Decision no.136/2002 for the approval of the Regulation on the identification of the relevant markets within the electronic communications sector was published in the Romanian Official Journal, part I, no. 338.

Four new relevant wholesale markets were identified and added to the ones already mentioned in the “Regulation for the identification of the relevant markets within the electronic communications sector”:

· The market of the provision of total or segmented access to the local loop consisting of one pair of twisted metallic wires for the purpose of providing broadband electronic communications services and publicly available telephony services at fixed locations.

· The market of providing bit stream” access to the local loop consisting of one pair of twisted metallic wires, optical fiber, coaxial cable, and radio local loop for the purpose of providing broadband electronic communications services.

· The market of providing leased lines-terminal segments services.

· The market of providing leased lines-trunk segments services.

Following the completion of this Regulation, ANRC will conduct market analyses on each of the newly-identified markets. In case operators with significant market power will be identified based on the market analyses, ANRC will impose them obligations under the law in order to stimulate competition development and to prevent power abuses. These obligations may refer to transparency, non-discrimination, separate accounting, the provision of certain services and granting access to certain facilities, as well as to charging cost-oriented tariffs.

The first version of this document was submitted to public consultation for one month, between November 22 and December 25, 2002. Taking into consideration the importance of the project and in order to receive comments from all the companies and institutions interested, the public consultation procedure was repeated between February 12 and 24, 2003. Following the synthesis of all observations received, the decision project was also analyzed during the last meeting of ANRC’s Consultative Council, where the representatives of the telecommunications industry, of ANRC and other institutions agreed on the final form of the document.
