In the first four months of 2004, the National Regulatory Authority for Communications carried out 1963 inspections, 1380 of which were inspections at the headquarters and outlets of the providers of electronic communications networks and services. 338 contraventions were detected and corrected by the measures mandated by the ANRC agents. 4 providers were notified as to the imminence of sanctions and one provider was given a formal warning. A number of 583 controls were conducted by ANRC at the headquarters or outlets of the postal services providers, where 79 contraventions were detected. These contraventions were corrected by the measures imposed, but not before 74 warnings had been given.
The most frequent violations are the non-compliance with the obligations under the general authorisation or under various ANRC decisions. The respective situations regard failure to notify ANRC about the change of the identification data of the companies or the types of services or networks the respective companies were authorized for. Situations were also detected such as failure to submit in time to the Authority the quality parameters for the provided services, statistical data or access and interconnection agreements concluded. Also, the ANRC inspectors identified a series of postal services providers who had not published their complaints solving procedure, their offer and the applicable tariffs, as well as the working hours.
During the controls, there was identified a commercial society that retransmitted audio-visual programmes through an unauthorised electronic communications network. This society was fined with the amount of ROL 50,000,000. In addition, ANRC made a denunciation to the General Police Department of Bucharest as there was a suspicion that the legal representative of one of the providers committed “forged material in official writs” and “use of forgery”.
The control activities of ANRC are conducted on grounds of the “Instructions regarding the survey and control activity of the National Regulatory Authority for Communications in the field of electronic communications and postal services” and the ”Sanctioning Regime Guide”, documents available for consultation on the Authority website.
In the following months ANRC will continue the control activities for the purpose of assessing the compliance with the provisions under the special legislation in the field of electronic communications and postal services, and with the obligations imposed through the general authorisations, licenses and the ANRC President’s Decisions.
