Today, May 28, 2004, the National Regulatory Authority for Communications launched for public consultation the draft Decision on the Amendment of ANRC President’s Decision no.136/2002 for the approval of the Regulation on the identification of the relevant markets within the electronic communications sector. This document completes the list of relevant wholesale markets previously defined by ANRC with the following relevant specific retail markets:

1. The market for access to the public telephone network at a fixed location for residential and non-residential customers;

2. The market for local calls, comprising origination of local calls for public telephone services, including dial-up and ISDN for Internet access services and facsimile services, for natural persons and legal persons, respectively;

3. The market for national calls, comprising origination of national calls for public telephone services, including facsimile services, for residential and non-residential customers;

4. The market for international calls, comprising origination of international calls for public telephone services, including facsimile services, for residential and non-residential customers;

5. The market for calls to public mobile telephone networks, comprising the origination at a fixed location of calls made to public mobile telephone networks from Romania for the public telephone services, including facsimile services for residential and non-residential customers.

Following their identification, the relevant specific retail markets will be analysed in order to determine the existence or the lack of efficient competition as well as to identify the providers with significant market power, should it be the case. These providers may be imposed remedies in accordance with Law no.304/2003 on the universal service and users’ rights relating to the electronic communications networks and services. These remedies are intended to prevent the abuse of dominant market position. Thus, by its actions, ANRC intends to ensure the access of end users to the specific advantages of a competitive environment characterized by a diversity of electronic communications services and competitive tariffs.

The new draft decision is available for consultation on the website of ANRC. All interested persons are invited to send their comments until June 28, 2004.
