Friday, November 26 2004, ANRC communicated Romtelecom 9 decisions by which this company is designated as a provider with significant power on the following relevant retail markets identified by the ANRC President’s Decision no.1124/2004:

The market of providing access at a fixed location to a public telephone network for natural persons;

The market of providing access at a fixed location to a public telephone network for legal persons;

The market of local calls at a fixed location for natural persons;

The market of local calls at a fixed location for legal persons;

The market of long distance calls at a fixed location for natural persons;

The market of long distance calls at a fixed location for legal persons;

The market of international calls at a fixed location for natural persons;

The market of international calls at a fixed location for legal persons;

The market of calls at a fixed location to public mobile telephone networks for natural persons.

Upon the designation of S.C. Romtelecom S.A as a provider with significant power on these markets, ANRC shall impose on this company – according to the provisions of Law no.304/2003 on the universal service and the users’ rights regarding the electronic communications networks and services – a set of obligations meant to promote competition on the respective specific relevant retail markets.

Based on the comments received during the consultation procedure and following the debates of the Consultative Council session, ANRC considered some operator’s arguments and agreed that the analysis of additional, further detailed data, which should enable the proper evaluation of the complex impact of providing E1-flow solutions or Premicell services directly connected in the non-residential end-users’ switchboards by the providers of mobile telephony public networks, as alternatives to the offer of S.C. „Romtelecom” – S.A., may lead to a better understanding of the competitive power of the providers of mobile telephony public networks on the respective market.

Therefore, ANRC decided to postpone the adoption of the ANRC President’s draft decision on the designation of S.C. „Romtelecom” – S.A. as a provider with significant power on the market of calls at a fixed location to public mobile telephone networks for natural persons. Upon the completion of the additional analysis on this market, ANRC shall take the appropriate measures, with a view to promoting competition and protect the end-users’ interests.

As well, ANRC communicated Romtelecom the ANRC President’s Decision no.1330/2004 amending and completing the ANRC President’s Decision no.147/2002 on the principles and prerequisites of the Reference Offer for Interconnection (RIO) with the fixed telephony public network, amended and completed by the ANRC President’s Decision no.1384/2003, and the ANRC President’s Decision no.1379/2003 on the interconnection of leased lines – terminal segments with the fixed telephony public network, as well as on imposing clauses in the Reference Interconnection Offer of Romtelecom.

This decision mainly envisages the amendment of the Romtelecom RIO regarding the leased lines – terminal segments services, respectively the provisions on the forecasting process, the due delivery terms, and the obligation to provide certain types of analogical leased lines based on the RIO. As well, the Decision clarifies certain aspects concerning the tariff for call origination from public pay telephones, the correlation of peak hours on the wholesale market with those on the retail market, as well as the calculation of the tariff charged by Romtelecom on the wholesale market for routing emergency 112 calls.
