Subsequent to the press declaration made yesterday, November 5, by Mr. James Hubley, CEO of S.C. Romtelecom S.A., the National Regulatory Authority for Communications would like to bring to your attention the following:

Mr. James Hubley, CEO of Romtelecom, stated yesterday that one of the projects of S.C. Romtelecom S.A., which he referred to as a Financial Systems Program, “is required to be implemented no later than June of next year by the ANRC”. Also, in an exclusive interview Mr. James Hubley gave to the Nine O’Clock magazine which was published in the November 4 issue, the manager of Romtelecom refers to a software system dedicated to providing detailed information about costs and mentions that this system was ”agreed by the National Regulatory Authority for Communications”.

We would like to emphasize the fact that the deadline mentioned by Mr. Hubley for the implementation of such a Financial Systems Program was not imposed to Romtelecom by any of the ANRC decisions in force at this moment. Furthermore, the representatives of Romtelecom have not submitted any such project to the attention of ANRC.

ANRC launched for public consultation two projects of regulations for the implementation of accounting separation within the internal cost accounting system, and for the elaboration of the “top-down” model for the calculation of the long run incremental cost by Romtelecom. Both regulations are still at the draft stage and currently undergoing further analysis, together with the comments communicated during the consultation period by representatives of S.C. Romtelecom S.A., as well as by other interested companies or persons. In its regulatory activity, ANRC always takes into account the operators’ comments on its draft decisions, and adapts its regulations to the Romanian market realities, as they emerge from an analysis process or as brought to our attention by the operators themselves.

The main objective of ANRC is protecting the interests of the Romanian consumers of communications services by stimulating the development of competition on the communications market. To fulfill this mission, ANRC imposes to the operator designated as having significant power in the market of access to public fixed telephone networks – Romtelecom – obligations meant to facilitate the market entry of alternative operators, and, at the same time, to stimulate the incumbent to adapt to a competitive market, by making its internal processes more efficient and by expanding and varying the range of its services. The National Regulatory Authority for Communications wants to make clear the fact that by its regulatory activity it does not aim at encouraging the management of Romtelecom to undertake inefficient or insufficiently prepared procedures.
