ANCOM has launched for public consultation a draft decision reviewing the provisions on setting the format and the means of transmitting information on the deployment and geographical location of public electronic communications networks and their associated physical infrastructure elements. The information to be transmitted to ANCOM will be used in conducting the national inventory of public electronic communications networks and of the associated infrastructure elements.
Amendments proposed by the draft decision
The draft decision proposes to introduce an obligation for all providers of public electronic communications networks to declare annually, between 1 September and 31 October, whether they hold ownership or concession rights over public electronic communications networks and/or physical infrastructure elements.
In the same vein, in order to ensure that the data collected reflect as closely as possible the current status of roll-out of public electronic communications networks and physical infrastructure elements, the Authority has decided that the transmission of the declaration on holding or not holding ownership or concession rights over public electronic communications networks and/or physical infrastructure elements should be made as compared to the situation in place at a certain reference date, to be observed by all providers of public electronic communications networks. In correlation with the period during which providers are required to report the information, the Authority set this reference date on the first day of the reporting period, i.e. 1 September.
Another amendment concerns the period within which persons who become providers of public communications networks must submit the declaration on ownership or concession of public electronic communications networks and/or physical infrastructure elements. Thus, according to the draft decision, entities that become providers of public electronic communications networks by 31 August of each year (including on that date), will submit the first declaration and – where appropriate, the information stipulated in the decision – during the reporting period corresponding to the year in which they acquired this quality. Entities that acquire the capacity of providers of public electronic communications networks starting from 1 September of each year will submit such information for the first time in the reporting period for the following year. Moreover, the provisions of ANCOM President’s Decision no. 336/2013, have been supplemented, extending the scope of this decision to include the submission of information on the deployment and geographical location of public electronic communications networks and of the associated physical infrastructure elements.
Public consultation process
The draft decision of the National Authority for Management and Regulation in Communications amending and supplementing ANCOM President’s Decision no. 134/2022 on setting the format and the means of transmitting information on the deployment and geographical location of public electronic communications networks and their associated physical infrastructure elements, and on supplementing ANCOM President’s Decision no. 336/2013 on the providers’ means and method of submitting documents, data or information to ANCOM has been launched in public consultation as a matter of urgency and is available, in Romanian, here.
