Consultative Council

V. After the public consultation procedure has been completed by means of the ANCOM site and upon processing the amendments based on the comments and suggestions received from the consulted partners, the draft regulations will be approached in final debate of the Consultative Council. The Consultative Council is made up of the following commissions: the Regulations Commission, the Studies and Analyses Commission and the Technical and Standardization Commission.
If a legally established association or another public authority forwards a written request in order to establish a meeting with a view to submitting to public debate a draft normative act launched for public consultation by ANCOM, the Authority will organise such a meeting at its headquarters, in compliance with the provisions of Law no. 52/2003 on decisional transparency in the public administration.
The agenda and the documents to be debated during each meeting of the Consultative Council will be published on the ANCOM Internet page, at least 7 days before the date on which the public meeting is programmed.
The minutes of the Consultative Council will be recorded, archived and made publicly available by means of the ANCOM Internet page. The minutes of other public meetings organised by ANCOM in accordance with the provisions of Law no. 52/2003 and according to point V, paragraph 3 herein, will be posted at the ANCOM headquarters and published on the ANCOM Internet page.
VI. At the latest, on the date of publishing the decision adopting the measure under public consultation on the ANCOM Internet page, the Authority will publish a summary of the comments, which will specify the ANCOM stand regarding the respective comments.
The comments and recommendations will be made publicly available by means of the ANCOM Internet page, except for the cases where the person submitting the respective comments required otherwise.
An annual report shall be drawn up, including the following details on the consultation activity:
number of projects under public consultation, among which:
– number of normative act drafts;
number of other drafts than normative act drafts;
– number of public sessions;
– number of non-public sessions and the reasons for restricted access;
– number of Consultative Council sessions;
number of normative act drafts adopted during the consultation;
number of normative act drafts adopted under emergency procedure;
– total number of recommendations received during the consultation;
– total number of recommendations included in the drafts under public consultation;
– total number of participants in the public sessions;
– total number of participants in the Consultative Council sessions;
– total number/average number of comments and recommendations received during the public sessions (if such a counting is possible)
– total number/average number of the comments and suggestions received during the Consultative Council sessions (if such a counting is possible)
– total number/average number of the above mentioned comments and suggestions included in the final version of the decisions (if such a counting is possible).
– total number of comments and recommendations received during the Consultative Council sessions, included in the issued decisions (if such a counting is possible)
– a report of the cases where ANCOM was sued for breach of the provisions of Law no. 52/2003;
– the institutions’ assessment of the partnership with the citizens and with their legally constituted associations.
